The rules and conditions for using Observer, including subscriptions, acceptable use, and your rights as a customer.

Acceptance of Terms

By downloading, installing, or using Observer ("the App"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the App.

These terms apply to all users of Observer. We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

Description of Service

Observer is a desktop application that provides AI-powered meeting assistance, including real-time transcription, AI-generated answers, Screen & Transcript based Q&A, and meeting summaries.

Observer primarily operates locally on your device and does not join meetings as a participant or bot. It processes audio and screen content from your system to provide its functionality.

User Responsibilities

You are responsible for:

  • Complying with all applicable laws regarding recording, transcription, or monitoring of conversations, including obtaining any required consent from participants
  • Using Observer only for lawful purposes
  • Keeping your account credentials secure
  • Not reverse engineering, decompiling, or modifying the App
  • Not using Observer for fraud, harassment, or illegal activity

Subscription and Billing

Observer offers paid subscription plans billed monthly.

For new plan purchases, the full plan amount is charged.

If you upgrade from Pro to Max, the full Max plan amount is charged.

All prices are in USD. Taxes are charged separately.

Subscriptions renew automatically unless cancelled. You can cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period.

Payments are handled by Paddle, which may store and process billing information under its policies.

If payment fails or is declined, we may suspend paid features until payment is completed.

We offer a 2-day refund policy for first-time paid subscriptions when technical issues prevent core app functionality.

Send refund requests to [email protected] within 2 days of the initial payment. Refunds are not provided for partial usage or change of mind.

Plan changes and evolution

Observer may update subscription pricing, plan features, AI models, integrations, usage allowances, meeting-hour limits, and overall plan structure from time to time as the product evolves.

When we make changes that affect your subscription, we will communicate them to you in advance when required by applicable law or when the change materially affects your plan. We will provide notice through reasonable channels, such as email, in-app notification, or an update on our website.

Changes apply prospectively to future billing cycles and will not be applied retroactively to amounts already paid.

If you are on an active paid subscription, you will retain the pricing, features, and usage allowances of your current plan for the remainder of your active billing period, unless a change is required sooner by law or necessary to address security, legal, or operational issues.

Observer reserves the right to introduce, modify, replace, or discontinue plan features, usage limits, and integrations as the service develops. If you do not agree with a change that takes effect after your current billing period, you may cancel your subscription before renewal.

Privacy and Data

Our Privacy Policy explains how we collect, use, and protect your data.

Observer does not store raw meeting audio.

Audio is processed in real time by third-party providers and is not retained by Observer.

Transcripts may be stored securely in our systems to provide features such as conversation history, meeting notes, and AI-generated responses.

Transcript data may be processed by third-party AI providers (such as OpenAI) to generate responses, but is not stored by those providers beyond processing.

We do not sell your data.

Intellectual Property

Observer and all associated software, branding, and content are owned by Observer.

You are granted a limited, non-exclusive, non-transferable license to use the App during your subscription.

You retain ownership of any content generated from your meetings, including transcripts and notes.

AI Generated Content Disclaimer

Observer provides AI-generated responses and summaries that may be inaccurate or incomplete.

You are responsible for reviewing and verifying all outputs before relying on them.

Observer is not responsible for decisions made based on AI-generated content.

Limitation of Liability

Observer is provided "as is" without warranties of any kind.

We do not guarantee that the App will be error-free or uninterrupted.

To the maximum extent permitted by law, Observer's total liability shall not exceed the amount you paid in the 12 months preceding the claim.

Termination

We may suspend or terminate your access if you violate these Terms or if required to comply with legal obligations.

You may stop using Observer at any time by cancelling your subscription.

Upon termination, your right to use the App ends immediately.

Governing Law

These Terms are governed by the laws of the Union Territory of Chandigarh, India.

Any disputes will be resolved in the courts of Chandigarh, India.
